The charges stemmed from alleged failures in the exchange's anti-money laundering program, which Zhao acknowledged and took responsibility for.
Court Proceedings
In April, Zhao received his sentence, which was notably lighter than the three years the federal prosecutors sought. The defense had requested five months of probation, while sentencing guidelines recommended a 12 to 18 months prison term.
The court's decision to deviate from both the defense's request and the sentencing guidelines was based on a variety of factors, including Zhao's cooperation with the investigation and his commitment to rectifying the issues identified in the exchange's operations.
Before his sentencing, Zhao addressed the U.S. District Court.
"I'm sorry. The first step in taking responsibility is to recognize the mistakes fully. Here, I failed to implement an adequate anti-money laundering program. ... I realize now the seriousness of that mistake."
Legal Settlement
In November 2023, Zhao, widely known as "CZ," settled with the U.S. government to conclude a multiyear investigation into Binance, the world's largest cryptocurrency exchange.
The settlement, which involved a significant financial penalty, marked a turning point for both Zhao and Binance, leading to Zhao's resignation as the company's CEO and a restructuring of the company's operations to ensure compliance with regulatory standards.
As part of the agreement, Zhao resigned as the company's CEO. Despite no longer being at the helm, Zhao reportedly retains an estimated 90% ownership stake in Binance.
Future Plans
After receiving the prison sentence, Zhao shared his plans post-incarceration. He emphasized that he plans to continue holding and passively investing in cryptocurrencies once he completes his four-month tenure in the Lompoc prison.
